We are Max Crowdfund NZ Limited (referred to as "we", "us" and "MC") .  We are committed to protecting and respecting your privacy when you are using our products through, but not limited to, our website ( as updated and maintained by us ( the “Site”), and any other correspondence, document or communication between us from time to time . 
Capitalised terms not otherwise defined in this Privacy Policy shall have the meanings given in the Terms and Conditions. This policy (together with the Terms and Conditions which can be found at the bottom of the Site) explains what types of personal and non-personal information we collect when you use the Site and the basis on which any personal data we collect from you, or that you provide to us, will be processed and used by us.

Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it. By disclosing your personal information to us by using the Site, emailing us, speaking to us over the telephone or communicating with us in any other way you consent to the collection, storage and processing of your personal information as stated in this policy. We use the personal information we collect from you to provide our service to you. We will not rent, sell, share or otherwise release your personal information to any other company for its own marketing purposes without your consent except where mentioned in this policy. 
For the purpose of the Privacy Act 2020 (“the Act”), its successors or implementing texts, the data controller is MC.  Personal information, when referred to in this policy, also has the same meaning as outlined in the Act.

What personal information do we collect?

We may collect, store and use the following kinds of personal information:

  • if you register as a User of the Site, you will be asked to complete a form which will require you to provide some or all of your name, address, date of birth, email address, telephone number, bank account details, crypto currency(ies) wallet details and certain anti-money laundering compliance information including your passport, proof of address and in some instances your source of wealth;
  • when you contact us by email or telephone or through any contact form provided on the Site, we may ask you to provide some or all of the information set out in paragraph (a) above;
  • we may collect, store and use information about your computer, mobile device or other item of hardware through which you access the Site and your visits to and use of the Site (including without limitation your IP address, geographical location, browser/platform type and version, Internet Service Provider, operating system, referral source/exit pages, length of visit, page views, Site navigation and search terms that you use); and
  • in order to improve your experience in using the Site, we may store information relating to your previous browsing habits and purchases in order to select and suggest Goods that may be of interest to you.

We may also ask you to complete surveys and give feedback that we use for research purposes, although you do not have to respond to them.

How do we use personal information?

We may use your personal information for the following purposes:

  • to manage and administer the Site;
  • to ensure compliance with any legal and compliance obligations (domestic or foreign) we are subject to;
  • to improve your browsing experience by personalising the Site;

  • to enable Brands to deliver Goods to you and to handle returns and refunds;

  • to publish generic transactional information relating to trades undertaken using the Site;

When might we disclose personal information?

  • your professional advisers, your authorised signatories and your agents;
  • other members of the Max organisation including any subsidiaries and related parties;
  • other companies or individuals who assist us in providing services or who perform functions on our behalf (such as mailing houses, hosting and data storage providers and financial advisers), and other companies or individuals who perform checks that are necessary or desirable under law on our behalf;
  • other companies, agencies or individuals that maintain databases against which your identity may be verified, which may include (but is not limited to) the New Zealand Department of Internal Affairs, New Zealand Transport Agency, and the Commonwealth of Australia Document Verification Service;
  • our professional advisers (such as our lawyers who assist us to ensure we are complying with our legal obligations), and banks and other financial institutions as part of our obligations when paying or receiving funds on your behalf;
  • courts, tribunals and regulatory authorities for the purposes of making or responding to legal claims or proceedings and enforcing contractual arrangements;
  • anyone who assists us to identify, prevent or investigate fraud, unlawful activity, misconduct or threats to our systems;
  • anyone else to whom you authorise us to disclose it; and
  • where we are required to do so by law.

Some of these organisations and parties may be located in New Zealand and some may be located around the world.

Newsletters and other promotional communications

If you wish to subscribe to any newsletter published by us or wish to receive other targeted and relevant promotional communications from us or other carefully chosen affiliates, we offer you the option to “opt-in” to this service. If you change your mind and wish to stop receiving any such communications, please click the “unsubscribe” link in any email from us or set the toggle in “My Account, “My Preferences” in the “Off” position.

Websites and Links

The Site may contain links or references to other websites both associated and not associated with us.  Our policy does not apply to those websites.  Information gathered by any other site will be subject to the Privacy Policy of those sites and we are not responsible for any information you choose to disclose to such a site.

Our use of cookies and web beacons

Cookies are text files stored, either on a temporary or permanent basis on the hard drive of your computer. Cookies are used for authenticating, session tracking and maintaining specific information about the use and Users of the Site. The data collected by cookies is anonymous. You can delete all cookies that are already on your computer's hard drive if you wish. In addition, if you want to stop cookies from being stored on your computer, you can edit your browser settings so that cookies are blocked. Unfortunately, if you block cookies you may not be able to use the full functionality of the Site. 

Web beacons consist of a small string of software code that represents a graphic image request on a page or email. There may or may not be a visible graphic image associated with the web beacon and often the image is designed to blend into the background of a page or email. Web beacons can be used for many purposes - including site traffic reporting, unique visitor counts, advertising auditing and reporting, and personalization. Web beacons used by the Site to collect only anonymous data.

In order to improve the Site and the services we offer you, we may use (temporary and persistent) cookies, authorised third parties cookies, web beacons and/or other technologies to collect non-personally identifiable data. This non-personally identifiable data helps us to track browsing behaviour, to create specific or tailor-made offers or advertisements, and to monitor and record the visits and use of the Site. In order to understand how people use the Site and for marketing analysis and quality improvement purposes, we (and/or third party service providers) may collect, record, process and use on an anonymous basis certain information including the total number of transactions, viewed pages, referring/exit pages, platform type, date/time stamp information and details like the number and location of mouse clicks on a given page, mouse movements, scrolling activity and the search words you use while being on and using the Site.

Where we store your personal data?

The data that we collect from you may be transferred to, and stored at, a destination outside New Zealand.  It may be stored in hard copy or electronically. It may also be processed by staff operating outside New Zealand who work for us or for one of our brands. By submitting your personal data, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy. All information you provide to us is stored on our secure servers. We take the security of your personal data very seriously. In particular we use all reasonable endeavours to ensure that appropriate security measures are in place to protect your personal data. Unfortunately, the transmission of information via the internet is not completely secure and so we cannot guarantee the security of your data transmitted through the Site and any communication or interaction with the site or with us is at your own risk. This Privacy Policy was last revised effective May 18, 2021. We reserve the right to amend this Privacy Policy. Any changes we may make to our Privacy Policy in the future will be posted on this page and, where you rights maybe detrimentally affected in a material way with respect to your privacy, notified to you by e-mail.


This Privacy Policy may be translated by Users of the Site. You irrevocably agree that the original language of this Privacy Policy is the English language. In case of a dispute the English version of this Privacy Policy will be the only legally binding version.
